General conditions of sale

Object :

These conditions of sale are concluded,

on the one hand, by the individual entrepreneur Adrien NAMURA, hereinafter referred to as “TORSADES” represented by Mr. Adrien NAMURA

on the other hand, by any natural or legal person wishing to purchase products or services via the website www.torsades.fr , hereinafter referred to as “the Customer”.

Geographic area:

The online sale of products and services presented on the Torsades.fr website is reserved for Customers residing in metropolitan Europe.

The order:

The Customer declares that they have full legal capacity to enter into these general terms and conditions of sale. The applicable conditions are those in force on the website on the day of the order.

To purchase one or more items or services, the Customer must follow the following ordering process:

1. adding products to the cart
2. identification: the Client will provide all the requested contact details
3. entry of the Customer's delivery and billing address
4. choice of delivery option: collection in store or Colissimo
5. regulation

Confirmation of the order entails acceptance of these conditions of sale, recognition of having full knowledge of them and the waiver of relying on any different or contrary clauses appearing on any other document.

During the ordering process, the customer can view the details of their order and its total price at any time and correct its content, before confirming it to express their acceptance.

Clicking on the "I confirm my order" button will constitute acceptance and proof of the conclusion of this sales contract. The customer explicitly acknowledges their payment obligation. Acceptance of the order cannot be subsequently challenged except in accordance with the "withdrawal period" article.

TORSADES will communicate by email the confirmation and the details of the registered order.

At any time, the Customer can access the details of their order via “My Account” under the “History and details of my Orders” section.

TORSADES reserves the right to cancel or refuse any order from a Customer with whom there is a dispute relating to the payment of a previous order.

Payment method :

To pay for their order, the Customer has different payment methods available:

by bank card (Carte Bleue, Visa, Eurocard/Mastercard):

Credit card transactions are the preferred method of paying for orders. Credit card payments are made through the CyberPlus Payment system provided by Bred, which uses the SSL (Secure Socket Layer) protocol to transmit bank details. The information transmitted is therefore encrypted by software, and no third party can read it during transport over the network.

by transfer :

All information necessary to complete the transfer is sent to the Client in a confirmation email.

Price :

The prices listed on the website www.torsades.fr are exclusive of VAT, VAT is not applicable (art. 293 B of the CGI) .

TORSADES reserves the right to modify its prices at any time, it being understood, however, that the price appearing in the catalog on the day of the order will be the only one applicable to the Customer.

A contribution to transport costs is charged in addition (see shipping costs section)

Delivery :

The products are delivered to the delivery address indicated by the Customer during the ordering process.

Regardless of the delivery method chosen, the Customer has access to tracking of their order through their Customer Account (My Orders section).

Home delivery by Carrier :

For products in the LANG YARNS range, shipping is done directly from Lang Yarns warehouses. Your package will be prepared the day after your order has been validated and paid for and will be handed over to the DPD carrier for shipping. Delivery to your home will then take 2 to 3 business days. You will receive an email allowing you to track the progress of your package.

If shipped from TORSADES Headquarters, your package will be shipped by Colissimo. The delivery time by Colissimo after the day of collection by the post office is 48 hours. Delivery by La Poste is made from Monday to Saturday. If you are absent when the package is delivered, a delivery notice will be left in your mailbox with instructions on how to collect your package (refer to the Colissimo general terms and conditions of sale).

It is the buyer's responsibility to provide the correct and complete delivery address. TORSADES cannot be held responsible for delivery incidents or additional costs resulting from an incorrect or incomplete address.

The customer is required to check the condition of the delivered items. Any anomalies noted (missing item, damaged package, broken item, etc.) must be reported within 4 days of receipt.

Delivery times:

The delivery times indicated in each product sheet are given as an indication and are understood to be from the validation of payment. TORSADES does its utmost to respect them.

In the event of a temporary stock shortage, TORSADES will endeavor to notify the Customer of the expected delivery time by email.

If the item becomes unavailable, the Customer will be informed as soon as possible and may then request a refund of the sums paid or opt for an exchange.

If delivery times exceed 30 days from the order, the sales contract may be terminated and the Customer reimbursed in full (goods and shipping costs).

We will refund your order within a maximum of 30 days and using the same payment method as the one chosen when ordering.

Shipping costs:

The total amount of shipping costs is specified at the start of the ordering process, in the shopping cart, and is calculated based on the destination and weight of the package.

Free shipping from €45.

Right of withdrawal:

The Customer has a withdrawal period of 14 calendar days from receipt of the goods by the Customer or a third party, other than the carrier and designated by the Customer.

To exercise your right, you must inform TORSADES in writing, within 14 days, of your intention to cancel all or part of the order, either by using the online withdrawal form or any other withdrawal form.

In all cases, we thank you for providing your customer references (customer number, order number, invoice number).

The costs incurred for returning the package are the responsibility of the Customer.

Returned items must be new, in perfect condition and in their original box.

Return Policy

You must return your package to us by tracked Colissimo no later than 14 days after sending the withdrawal form accompanied by your invoice to the following address: Adrien Namura – 3 anc ch de St Pierre de Féric, 06000 NICE.

The customer must keep proof of delivery of the package. Without this proof, no exchange or refund can be made in the event of loss of the package.

We will refund the amount of your order (goods excluding initial shipping costs) as soon as possible and at the latest within 14 days of receipt of your package in our services by the same payment method as that chosen when ordering.

However, you have the option of choosing another method of reimbursement from those accepted on the site (credit card or check), simply indicate this to us on a plain piece of paper in your return package.

Exceptions

The right of withdrawal cannot be exercised for goods made at the request of the Customer, newspapers and catalogs, damaged or unsealed items.

Product information:

TORSADES informs the Customer of the essential characteristics of the goods offered (sizes, colors, compositions, descriptions, prices).

The photos illustrating the products are not part of the contractual scope. The Customer acknowledges that the photograph representing the product appearing on the website is for informational purposes only. The photographs in the catalog are as faithful as possible but cannot guarantee perfect similarity with the item offered, particularly with regard to colors.

Product Warranty:

The customer is expressly informed that TORSADES is not the producer of the products presented on the website, within the meaning of Law No. 98-389 of May 19, 1998, relating to liability for defective products. Consequently, in the event of damage caused to a person or property by a product defect, only the liability of the producer of the product may be sought by the customer, based on the information appearing on the packaging of said product.

Personal data - GDPR :

The data collected by TORSADES on the website www.torsades.fr is intended exclusively for TORSADES. It is used solely for the proper management of your orders and their shipments. You may object to the use of the data collected under this order, as part of TORSADES' customer database.

In accordance with Law No. 78-17 of January 6, 1978, known as the Data Protection Act, you have the right to access, rectify, and delete any information concerning you. Intellectual property :

All elements (information, data, brands, logos, photos, etc.) present on the site www.torsades.fr are the exclusive property of TORSADES and are protected by copyright, trademarks or patents.

Dispute Resolution :

In the event that a dispute arises from this contractual relationship, the parties undertake to seek an amicable solution before any legal action.

In the event of legal action, the competent court will be that of the defendant's place of residence, or at the plaintiff's choice, that of the place of actual delivery of the package. French law will apply.
